LIABILITY WAIVER AND MEMBERSHIP AGREEMENT

In consideration of the risk of injury while participating in martial arts training and related activities (the “Activity”), and as consideration for the right to participate in the Activity, I, the undersigned, for myself, my heirs, executors, administrators, assigns, and personal representatives, knowingly and voluntarily enter into this Waiver and Release of Liability and hereby waive, release, and discharge any and all claims, causes of action, or liabilities of any kind whatsoever arising out of my participation in the Activity.

I further release and forever discharge Bragiao BJJ MMA, located at 4-831 Kuhio Hwy, Suite 438–446, Kapaʻa, HI 96746, including its owners, affiliates, managers, members, agents, instructors, staff, attorneys, volunteers, representatives, heirs, predecessors, successors, and assigns (collectively, the “Released Parties”), from any and all physical or psychological injury, including but not limited to illness, paralysis, death, damages, economic loss, or emotional distress that I may suffer as a direct or indirect result of my participation in the Activity, including travel to and from any events or training sessions.

I acknowledge that I am voluntarily participating in the Activity entirely at my own risk. I am aware of the inherent risks associated with martial arts training, including but not limited to physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability (including paralysis), economic or emotional loss, and death. I understand these injuries may result from my own actions or omissions, those of others, or the conditions in which the Activity takes place. Nonetheless, I assume all risks, known and unknown, connected with my participation in the Activity, including travel to, from, and during the Activity.

I agree to indemnify and hold harmless Bragiao BJJ MMA and the Released Parties from any and all claims, suits, actions, damages, liabilities, losses, costs, or expenses (including attorney’s fees) arising from or related to my participation in the Activity. Should Bragiao BJJ MMA incur any such costs or expenses as a result of any claim by me or anyone acting on my behalf, I agree to reimburse the gym in full.

I acknowledge that Bragiao BJJ MMA and its directors, officers, representatives, and agents are not responsible for the acts, omissions, or negligence of any third parties conducting events or activities on behalf of the gym.

MEMBERSHIP TERMS AND CANCELLATION POLICY

All memberships with Bragiao BJJ MMA are provided on a month-to-month basis and do not constitute a long-term contract or fixed-term commitment. Memberships automatically renew each month unless and until properly cancelled in accordance with the following terms:

1. A minimum of thirty (30) days’ written notice is required to cancel, suspend, or modify any membership.

2. All written requests must be submitted via email to bragiaobjjmma@gmail.com and received no later than thirty (30) days prior to the next scheduled billing date.

3. Cancellations and suspensions become effective thirty (30) days from the date written notice is received. Members remain financially responsible for any dues or fees incurred during that notice period.

4. Verbal requests or communications made via phone, text message, or social media will not be accepted as valid notice.

5. Exceptions for medical emergencies or other extenuating circumstances may be granted at the sole discretion of Bragiao BJJ MMA management, evaluated on a case-by-case basis.

By signing below, the member affirms understanding and acceptance of these membership terms and acknowledges responsibility for timely submission of written cancellation or suspension requests.

I acknowledge that participation in martial arts involves a test of a person’s physical and mental limits and may carry the potential for death, serious injury, and property loss. Risks may include, but are not limited to, those caused by terrain, facilities, temperature, weather, hydration, condition of participants, equipment, vehicular traffic, and actions or omissions of others.

I have carefully read and fully understand this Waiver and Release of Liability, and I voluntarily agree to its terms. I expressly agree to release and discharge Bragiao BJJ MMA and all Released Parties from any and all claims or causes of action, and I voluntarily waive any right to bring a legal claim for personal injury, property damage, or other loss.

This release includes claims based on the negligence of Bragiao BJJ MMA, its agents, employees, and representatives. If I require medical care or treatment during participation, I will be financially responsible for all associated costs. I acknowledge that I am encouraged to maintain my own health insurance coverage.

If any damage to equipment or facilities occurs as a result of my willful actions, neglect, or recklessness, I agree to be held liable for the costs of repair or replacement.

This Agreement is entered voluntarily and without duress or coercion. If any portion of this Agreement is held invalid or unenforceable, the remainder shall remain in full force and effect.

By signing below, I acknowledge that I am at least 18 years of age and am freely signing this Agreement. I have read and understand its contents and recognize that it is a legally binding release of liability.

If the participant is under 18 years of age, a parent or legal guardian must sign on their behalf, giving consent without reservation to the foregoing terms.
